<p><span style="font-family: Verdana; font-size: x-small;">For over 10 years Eric has been a leader at the State House in support of smaller more efficient government and in controlling government spending and opposing tax increases.</span></p>
<p><span style="font-family: Verdana; font-size: x-small;">Eric’s efforts to bring together social and fiscal conservatives was highlighted in a column by Russ Pulliam in the <em>Indianapolis Star</em> on Friday, August 20.</span></p>
<p><strong>Tea partiers welcome</strong></p>

<p>Conservative political activist Eric Miller<br />
sees common ground between the tea<br />
party movement and his 30-year<br />
advocacy of traditional family values.</p>
<p>The founder of Advance America thinks<br />
the tea party will be a significant help in<br />
November to candidates who favor<br />
smaller government.</p>
<p>Miller is planning Take Back America<br />
rallies this fall in Indianapolis and other<br />
Indiana cities (www.advanceamerica.<br />
com), along with voter guides, to<br />
encourage limited government voters to<br />
see clear differences among candidates.</p>
<p>Advance America has argued for<br />
traditional pro-life, pro-family values<br />
but also appeals for smaller government a<br />
nd lower taxes. Miller ran for governor<br />
in 2004, drawing more than 144,000 votes<br />
in the Republican primary. Mitch Daniels<br />
carried the race with 284,000 votes.</p>
<p>This year the tea party movement has<br />
stirred up sentiment for a libertarian-<br />
type emphasis on lower taxes and less<br />
government.</p>
<p>&#8220;The typical tea party person I meet has<br />
not been involved in politics before,&#8221;<br />
Miller said. &#8220;There&#8217;s a whole segment who<br />
may not go to every tea party rally. They<br />
feel cut off from their government. They<br />
are in their 40s and 50s and 60s and 70s.<br />
They will be OK financially. </p>
<p>They&#8217;ve worked, raised their kids, paid for their<br />
homes. But they are concerned for their<br />
children and grandchildren.&#8221;</p>
<p>Although most tea party sympathizers<br />
are economic conservatives, some aren&#8217;t<br />
convinced about Advance America&#8217;s<br />
emphasis on morality. Miller, however,<br />
argues that many tea party enthusiasts<br />
have an instinctive sympathy for his<br />
family values thrust. &#8220;They know that<br />
America has drifted morally,&#8221; he said.<br />
&#8220;They hold to traditional values of hard<br />
work, individual responsibility, of a<br />
moral ethic that certain things are right<br />
and certain things are wrong.&#8221;</p>
<p>Still, it&#8217;s unclear whether Advance<br />
America&#8217;s conservative social values will<br />
appeal to tea party members. Republican<br />
leaders such as Ronald Reagan and, more<br />
recently, U.S. Rep. Mike Pence have found<br />
success by building a coalition of social<br />
conservatives and small government<br />
libertarians. Quite often neither wing of<br />
the party can win an election without the<br />
other.<br />

<p><span style="font-family: Verdana; font-size: x-small;">On August 4, 2010 in San Francisco Chief U.S. District Judge Vaughn Walker ruled that Proposition 8, <strong>which defined marriage as between one man and one woman</strong>, was unconstitutional.  Proposition 8 was approved by the voters of that state in November, 2008 just a few months after the California Supreme Court ruled that same sex marriages were legal.</span></p>
<p><span style="font-family: Verdana; font-size: x-small;">Commenting on Judge Walker’s Ruling, Pastor Jim Garlow of Skyline Wesleyan Church in La Mesa, California said:</span></p>
<p><span style="font-family: Verdana; font-size: x-small;"><em>“He simply ripped from the state of California and seven-million voters the chance to articulate the definition of marriage that’s been accepted for over 5,000 years.”<br />

<p><strong><span style="font-family: Verdana; color: #ff0000; font-size: medium;">What’s Next In California?</span></strong></p>
<p><span style="font-family: Verdana; font-size: x-small;">Judge Walker’s decision will now be appealed to the 9<sup>th</sup> U.S. Circuit Court of Appeals.  The next step would be an appeal to the U.S. Supreme Court.</span></p>
<p><strong><span style="font-family: Verdana; color: #ff0000; font-size: medium;">What About Indiana?</span></strong></p>
<p><span style="font-family: Verdana; font-size: x-small;">While the appeal of Judge Walker’s ruling works its way through the judicial system, Indiana still does not protect marriage between one man and one woman with a Constitutional Amendment.  The 2011 Indiana General Assembly should pass a Constitutional Amendment to begin the process to protect marriage in our state.  Advance America will continue to help lead this effort to protect marriage in Indiana.</span></p>

<p><span style="font-family: Verdana; font-size: x-small;">The Council voted to continue discussion of the Ordinance when it appeared it would have been defeated.  We won on July 26<sup>th</sup> when the Ordinance was not approved; but it will no doubt come back up later in the year!</span></p>
<p><strong><span style="font-family: Verdana; color: #ff0000; font-size: medium;">Professor Charles Rice Speaks Out Against Ordinance!</span></strong></p>
<p><span style="font-family: Verdana; font-size: x-small;">Dr. Charles Rice, Professor Emeritus of Notre Dame Law School also opposed Ordinance 30-10.  Here is a portion of his letter to the editor of the <em>South Bend Tribune</em>.</span></p>
<p><em><span style="font-family: Verdana; font-size: x-small;">“Bill 30-10 exempts religious entities from its prohibitions, but that is illusory.  It applies only ‘when such protections affect the definition, advancement of the mission(s), practice(s) or belief(s)’ of the religious entity.  The commission would decide whether the entity is so affected.  Could the commission contradict a church on the church’s own definition of its mission?”</span></em></p>

Jefferson Blvd. (at the corner of Jefferson and Lafayette) in South Bend.</span></p>

<p><strong><span style="font-family: Verdana; font-size: medium;">Judge: Federal gay marriage ban unconstitutional </span><span style="font-family: Verdana; font-size: xx-small;">Denise Lavoie | Associated Press</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">BOSTON &#8211; A U.S. judge in Boston has ruled that a federal gay marriage ban is unconstitutional because it interferes with the right of a state to define marriage.</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">U.S. District Judge Joseph Tauro on Thursday ruled in favor of gay couples&#8217; rights in two separate challenges to the 1996 Defense of Marriage Act, known as DOMA.</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">The state argued the law denied benefits such as Medicaid to gay married couples in Massachusetts, where same-sex unions have been legal since 2004.</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">Tauro agreed, and said the act forces Massachusetts to discriminate against its own citizens.</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">&#8220;The federal government, by enacting and enforcing DOMA, plainly encroaches upon the firmly entrenched province of the state, and in doing so, offends the Tenth Amendment.  For that reason, the statute is invalid,&#8221; Tauro wrote in a ruling in a lawsuit filed by Attorney General Martha Coakley.</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">Ruling in a separate case filed by Gays &amp; Lesbian Advocates &amp; Defenders, Tauro found that DOMA violates the equal protection clause of the U.S. Constitution.</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">&#8220;We&#8217;ve maintained from the very beginning that there was absolutely no basis for this law treating one class of married Massachusetts couples different from everybody else and the court has recognized that,&#8221; said Gary Buseck, GLAD&#8217;s legal director. </span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">The Justice Department argued the federal government has the right to set eligibility requirements for federal benefits &#8211; including requiring that those benefits only go to couples in marriages between a man and a woman.</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">The law was enacted by Congress in 1996 when it appeared Hawaii would soon legalize same-sex marriage and opponents worried that other states would be forced to recognize such marriages.  The lawsuit challenges only the portion of the law that prevents the federal government from affording pension and other benefits to same-sex couples.</span></strong></p>
<p><strong><span style="font-family: Verdana; font-size: xx-small;">Since then, five states and the District of Columbia have legalized gay marriage.</span></strong></p>

<p>What will happen when the economy turns around and more money starts to flow into state and local governmental units? As their revenue increases will the elected officials increase dramatically their spending or will they control their spending increases and put an appropriate amount into a rainy day fund to handle the next economic downturn?</p>
<p>Advance America supports controlling spending increases by imposing a spending cap to permit spending to only go up by inflation and population growth.  This will help prevent future tax increases.</p>
<p>Always remember this is your government!</p>

<p>Unfortunately, Senate Bill 198 did not pass the 2010 General Assembly.</p>
<p>This bill will hopefully be reintroduced in the 2011 General Assembly.</p>

If legislators are not made to hold the line on spending, they may be looking at ways to bring in more money from the taxpayers.</p>
<p>One approach that they may take is to start taxing services. The non-partisan Indiana Fiscal Policy Institute did an analysis of the impact of imposing Indiana&#8217;s 7% sales tax on service transactions.  They found that the state could take in $6.7 billion annually.  What do you think?  If you have an opinion about the State of Indiana raising taxes by expanding the sales tax to services contact your Senator and Representative. </p>

<p><strong><span style="font-family: Verdana; color: #ff0000; font-size: medium;">Victory in Goshen Was By One Vote Too!</span></strong></p>
<p><span style="font-family: Verdana; font-size: x-small;">Last September the Goshen City Council voted <strong>against</strong> a local ordinance to give government recognition to male cross-dressers.  Had the Goshen ordinance passed then male cross-dressers would have been given legal access to <strong>women’s restrooms, women’s dressing rooms, </strong>and<strong> women’s locker rooms</strong> in Goshen!  Fortunately for the women and girls in Goshen the Goshen City Council voted to <strong>defeat</strong> the ordinance by <strong>one vote – 4-3!</strong></span></p>
<p><span style="font-family: Verdana; font-size: x-small;"><strong><strong><span style="font-family: Verdana; color: #ff0000; font-size: medium;">State Law Could Be Introduced in 2011!</span></strong></strong></span></p>
<p><span style="font-family: Verdana; font-size: x-small;"><span style="font-family: Verdana; font-size: x-small;">Representative Mary Ann Sullivan introduced House Bill 1250 in the 2009 General Assembly.  Had House Bill 1250 become law then Indiana would have given government recognition to “gender identity.”  This would have given male cross-dressers legal access to women’s restrooms, women’s locker rooms and women’s dressing rooms throughout the entire State of Indiana!  This bill could be re-introduced in the 2011 General Assembly!</span></span></p>
<p><span style="font-family: Verdana; font-size: x-small;"><strong><span style="font-family: Verdana; color: #ff0000; font-size: medium;">It Happened in Colorado and It Could Happen in Indiana!</span></strong></span></p>
<p><span style="font-family: Verdana; font-size: x-small;"><span style="font-family: Verdana; font-size: x-small;"><strong>Women</strong> and <strong>girls</strong> in Colorado are at risk because a state law was passed in 2008 giving men who dress as women (<strong>male cross-dressers</strong>) legal access to <strong>women’s restrooms, women’s locker rooms</strong> and <strong>women’s dressing rooms</strong> throughout Colorado.  This could happen in Indiana too!</span></span></p>
<p><span style="font-family: Verdana; font-size: x-small;"><strong><span style="font-family: Verdana; color: #ff0000; font-size: medium;">Advance America Will Continue To Oppose This Legislation!</span></strong></span></p>
<p><span style="font-family: Verdana; font-size: x-small;"><span style="font-family: Verdana; font-size: x-small;">Advance America will continue to lead the effort at the State House – as we have for over 25 years – <strong>to protect churches and families.</strong>  This means we will continue to work with Senators and Representatives and oppose any legislation that would give <strong>male cross-dressers</strong> legal access to <strong>women’s restrooms</strong> and other areas where <strong>women and girls expect and deserve privacy </strong>from men.</span></span></p>
